What is the Fair Housing Act?
The Fair Housing Act prohibits discrimination in housing based on race, color, national origin, religion, sex, familial status, and disability. Violations can result in significant penalties.
Federal Protected Classes
You CAN
- ✓ Screen all applicants using the same criteria
- ✓ Require proof of income (typically 3x rent)
- ✓ Run credit and background checks
- ✓ Verify rental history and references
- ✓ Require renters insurance
- ✓ Set reasonable pet policies (except service animals)
- ✓ Enforce lease terms equally
You CANNOT
- ✗ Refuse to rent based on protected class
- ✗ Ask about disability, religion, or family plans
- ✗ Steer tenants to certain units/neighborhoods
- ✗ Refuse reasonable accommodation requests
- ✗ Charge different rent/deposits based on protected class
- ✗ Deny service animals or emotional support animals
- ✗ Advertise preferences for protected classes

✓ Safe to Say:
- "2 bedroom apartment"
- "Near public transportation"
- "Quiet building"
- "Recently renovated"
- "Pet-friendly"
